Tribal Energy Resource Agreements (TERAs)

On December 18, 2019, the Final Rule published in the Federal Register, and a copy is available here.

Tribal Energy Agreements (TERAs) promote Tribal control over energy development on Tribal lands and offer the potential for economic growth.  On June 17, 2019, the Assistant Secretary - Indian Affairs announced proposed changes to the TERA regulations and an upcoming listening session and consultations for input on the proposed changes in a Tribal Leader letter.  The proposed changes aim to remove hefty regulatory requirements and proposes to establish an alternative to TERA through a certification of Tribal Energy Development Organization (TEDO).  To view the proposed rule, please click here. In addition, a red-line version showing the changes from the current regulations to the proposed regulations is available here.

In addition, the presentation made available at the consultation sessions is also accessible here.
