Section 105(l) Leases

Section 105(l) of the Indian Self-Determination and Education Assistance Act (ISDEAA) provides that Tribes and Tribal organizations carrying out Federal functions under a self-determination contract or self-governance compact may enter into a lease agreement with the Department of the Interior (DOI) for the Tribally owned or rented facility used to carry out those functions. Under as Section 105(l) Lease, DOI negotiates with the Tribe or Tribal organization on eligible expenses for use of the facility to carry out the contract or compact function.

Tribal Consultation

On Tuesday, July 27, 2021, the Principal Deputy Assistant Secretary - Indian Affairs and the Acting Director, Indian Health Service invited Tribes to consult on a number of questions regarding process and facility size for 105(l) leases.  The consultation session is scheduled for August 27, 2021, 1pm - 3pm Eastern Time, by webinar.  Details are included in the Dear Tribal Leader letter.  

Past Listening Sessions

On Friday, June 19, 2020, the Assistant Secretary - Indian Affairs announced in a letter to Tribal Leaders a series of listening sessions to learn about this framework and answer any questions regarding these new and unique agreements.
