The Department of the Interior (Department) is pleased to announce its proposed rule amending regulations governing implementation of subchapter IV of the Indian Self-Determination and Education Assistance Act (ISDEAA) and the Department’s Tribal Self-Governance Program. The Practical Reforms & Other Goals to Reinforce the Effectiveness of Self Governance & Self Determination for Indian Tribes (PROGRESS) Act called for these updates. Pub. L. No. 116-180 § 413, as amended by Pub. L. No. 118-15, § 2102.
This Proposed Rule came from a Negotiated Rulemaking Committee (Committee) process, as required by the PROGRESS Act, and subject to the Federal Advisory Committee Act. 5 U.S.C. § 1001, et seq., Pub. L. No. 116-180, § 413. Members of the Committee included seven primary Tribal representatives, seven alternate Tribal representatives, six primary Federal representatives, and six alternate Federal representatives. The Committee met fifteen times between August 2022 and April 2024 to negotiate and generate text of the Proposed Rule. The Committee’s report detailing its deliberations and areas of consensus and non-consensus is available in the materials section below, as well as a copy of the proposed rule and Dear Tribal Leader Letter. The Department extends its sincere gratitude to Tribal and Federal members of the Committee for their extended time investment.

Given the nature of collaborative drafting inherent to the Committee’s work, the Department seeks any comments on the enclosed Proposed Rule, including input on the following question:
